What is a Contingency on a Contract?

What are contingencies on real estate contracts and how do you deal with them? What do they mean? What are the course of actions that I would need to take as a buyer? As a seller?

There are many contingencies built into real estate contracts. They are there to protect the buyer and sellers, and to ensure that certain criteria is met prior to finalizing or closing on a property. Depending on the type of contract, whether you are the buyer or the seller, the contingency has slightly different look and feel, but in the end the condition needs to be met to the satisfaction of all parties (sellers, buyers,lenders) for the contingency to be met and released.

So what is the risk of not meeting the contingency? As a buyer, your Earnest Money Deposit (EMD) is at risk, as the seller can put a claim on the funds due to the buyer missing deadlines and not meeting the contingencies on a timely basis. As a buyer, as long as you meet the timelines, communicate with the seller, and follow protocol if you need to ask for a Release & Cancellation of Contract, you can claim your EMD and get it returned to you. It is incumbent on your Real Estate Agent to manage and educate you, on a timely basis, on the conditions, actions, and timelines. We are the Real Estate Pros for a reason!! We guide you through the process and make sure we take care of you, protect you and communicate with you, buyer and or seller.

Lets talk making an offer and what happens after that. When an offer is made on a home, the seller can do one of 3 things. Accept the offer, and now you are under contract. Hurray!! Reject the offer and now the offer is “dead��. Bummer!! Or counter the offer. That means the seller is countering your offer terms, it could one of several such as price, whats included, closing dates, inspection periods, appraisal periods or a host of other items.

To continue on our current topic, lets talk about other project that add value to your home. In the past we have discussed some of the “what not to do��, simple items like painting the front door. Now lets build on that.

Small paint project can make a big difference in that all important first impression on buyers. Areas where paint can improve are doors, window frames, door frames, base boards, all the trim that should be clean and freshly painted for it to add pop to a room or a home. Accent walls are also great, but remember stick to neutral colors.

Remember your grandparents home, and the endless wall paper. Wallpaper has come a long way in terms of style and look, and its easy to upgrade a room with it. What is difficult is to change it. Have you ever tried to remove wallpaper. I have and that was NOT FUN!!! So if you are going to use it, use it as a way to accent a wall, not necessarily a whole room.

Speaking of colors, Saffron, seems to be pegged as the color for 2020. Is that your style? Its very different than the previous trend of grey, beige, blue, and white. These next few weeks we will explore and focus on renovations, how they can help or hurt the value of your home as well as which types on upgrades and fixes actually have the highest Return on Investment (ROI), and which don’t. As many people prepare for the “selling season�� now its the time to start planning on what TO do and what NOT to do.

Some of the biggest personalizations that hurt value are are expensive and not as popular, or fleeting in time as a fad, not truly something lasting. Lavish light fixtures are of days gone by, and can be a huge turn off to a buyer. Wallpaper, though easy to put on (relatively speaking), its impossible to get off, and a huge turn off.

Crazy designs on carpeting or counters are a no-no. These will definitely hurt your values and appeal. Crazy bathroom decorations with designs, tile or mirrors that can drive you crazy if you look at them too long.

Fortunately, you can easily correct those mistakes.

Nothing is more personalized than sun rooms, Florida rooms, porches, and aquariums. Though a great upgrade for some, and allow a lot of individualism, buyers might not like it or want to expense of removing or changing the design.
